This page explains the terms of use on which we operate our website and how you can use the website. By using our website, you indicate that you accept these Terms and Conditions. Reference in these Terms and Conditions to “we”, “us”, “our” and “McElhinneys” refers to John McElhinney UC, Main Street, Ballybofey, Co. Donegal. Company Registration Number: 54692. Our website is controlled and operated in Ireland. Any terms and conditions concerning the usage of this website will be governed by Irish Law.
Before proceeding with an order, you are required to show that you have read and understood the following terms and conditions. We recommend that you print a copy of these Terms and Conditions. If you do not agree or abide by the Terms and Conditions associated with the use of our website, we recommend that you stop using www.mcelhinneys.com immediately.

3. Products and Pricing
We take every care to ensure that product descriptions are accurate at the time of uploading products to the website. We reserve the right to withdraw any product from the website without any prior notification. Whilst we make every effort to provide relevant and accurate product information, photography, imagery, and to represent colours and textures correctly. We cannot guarantee that it is always accurate. Products may display differently depending on the device used by the customer.
Goods sold are subject to availability and may sell out and may not be repeated. In circumstances, where customers have an item(s) in their shopping basket and have yet to complete payment, should the item go out of stock before payment is completed, we fulfil orders based on the first order received. We make every effort to display our full catalogue on our website however there are certain items which are only available instore. For specific information on brands, call us on 0749131217 or email customerservice@mcelhinneys.com. Some products are unable to be shipped to certain countries due to import restrictions and courier challenges. You will be notified of any restricted items in your shopping bag when you proceed to checkout.
Our products are priced in Euro. We also reserve the right to amend the prices of products without prior notification. We make every effort to ensure pricing on our website is correct, however, errors can occur. If we identify a pricing error on an order, we will contact you and give you the option to cancel the order or to reconfirm the order at the correct price. In instances where we are unable to make contact with you, we will cancel the order of items sold.
When purchasing products with sterling or other currencies, debit or credit cards, the exchange rates will be set by the cardholder’s bank. These rates fluctuate daily. All prices shown on our website are inclusive of VAT at the rate appropriate for the product type.
4. Ordering Goods
Our display of products on our website is an invitation and not an offer to sell those goods to you. You may only place an order on our website if you are legally capable of entering a binding contract with us and if you are the authorised cardholder or account holder. When an order is placed on our website, you will receive a confirmation email acknowledging we have received your order and it is being processed. The onus is on you the customer to enter your correct email address, contact number and postal information at the time of order. Please take care to enter details accurately as a wrong entry of contact information may result in an individual receiving your order details.
All products are subject to availability. We reserve the right to cancel an order in certain circumstances:
- Product(s) ordered are out of stock,
- Item(s) subject to a delay or we cannot fulfil
- Price error identified
- Product wrongly described or fault identified
- Payment not authorised or failed payment validation checks
- In an instance where an order or an item from the order is cancelled we will try to contact you via the email address or telephone number you provided when placing your order. If we cannot contact you or if we receive no response to our email, we will continue to process any remaining products on your order. We will not supply a replacement product without your authorisation. We reserve the right to courier items in a single order separately.
We will send a second email confirming your order has been dispatched with a tracking number where applicable. Only when you receive the confirmation email detailing the items which have been displaced is the completion of the sale of goods contract between us and you.
5. Gift Cards
Digital Gift Card
Our Digital eGift Card is a virtual card that is sent to your email instantly. The eGift Card comes with a unique code which you can then use during checkout on our website. If you are purchasing this digital eGift Card as a gift for someone else, you have the option to print it or forward it via email to the chosen recipient once received.
The Digital Gift card can be accepted as payment online only.
Gift Card by Post
We offer FREE post service for all physical Gift Cards ordered. Gift Cards will be dispatched within 24 hours of order and can be personalised with a message if requested at the time of order. We reserve the right not to include a gift message that is deemed to be abusive, racist, vulgar, sexual, violent, hateful, profane, or offensive. We expect all users on our website not to use profane or offensive language. All physical Gift Card orders are sent with An Post postal service.
Gift Cards cannot be returned once purchased and cannot be exchanged for cash or other gift cards. Physical Gift cards purchased in-store or on our website cannot be used as a form of payment on the website; they may only be used in-store. We cannot take responsibility for any gift cards that are lost, stolen, or used by someone after delivery. If placing an order for a gift card, it is your responsibility to ensure the recipient has received their gift card. We use reliable postal services however we shall be under no liability for any delay or failure to deliver the parcels within the estimated timescales.
6. Payment Options
Currently, we do not accept McElhinneys Gift Cards (physical/ by post gift cards) online. We do accept the Digital eGift Card as a form of payment online.
We accept the following forms of payment online, Visa, Mastercard, American Express, PayPal, Revolut Pay. We also offer buy now and pay later options with Humm. For more information on Humm, click here https://www.mcelhinneys.com/humm/
7. Delivery
The successful delivery of your order relies on you inputting the correct shipping address and contact information when completing your order on our website. This includes inputting the full name, full address including door numbers, street names, and eircodes/postcodes. Please include your contact landline or mobile number and an email address that you review regularly. When we receive orders that do not provide adequate and accurate information, we cannot deliver goods in the specified times outlined below. The onus is on you the customer to enter accurate delivery information at the time of order, we cannot be held responsible for orders going missing or delayed due to incomplete delivery information.
In instances where customers do not select the correct delivery method, we will contact the customer to pay outstanding postage costs.
Ireland & Northern Ireland Delivery
We offer FREE delivery on Gift cards and regular priced purchases over €69. We charge €5.50 postage for purchases less than €69 and for all sale reduced goods. We charge €15.00 to deliver heavy household items. All orders received before 3PM Monday to Thursday with a delivery address in Ireland and Northern Ireland should be received by the customer within 48 hours. Orders placed on a Friday and over the weekend will be dispatched on a Monday morning for delivery on a Tuesday.
Our chosen courier partner for Ireland and Northern Ireland is DPD registered delivery service. For all parcels dispatched with DPD, the recipient will receive a notification via email and/or a text message to their mobile to confirm the goods have been dispatched along with a track and trace number. You can check the status of your order on www.dpd.ie.
On occasion, we will use An Post registered postal service.
Scotland & UK Delivery
We offer FREE delivery on Gift cards. We charge €5.50 postage for all other purchases to the UK. We charge €15.00 to deliver heavy household items. All orders received before 3PM Monday to Thursday with a delivery address in mainland Scotland and UK should be received by the customer within 2-4 working days. Orders placed on a Friday and over the weekend will be dispatched on a Monday morning.
Orders posted to Scotland and UK are primarily dispatched with Royal Mail registered postal services.
For all parcels dispatched with Royal Mail, the recipient will receive a notification via email to confirm the goods have been dispatched along with a track and trace number. You can check the status of your order on https://www.royalmail.com/track-your-item
Europe and Rest of World
The cost of postage varies depending on the region - rates range between €10.00 and €30.00. For heavier products such as saucepan sets etc. cost of postage can range between €45.00 and €90.00. Delivery can take up to 10 days to European countries and 20 days for the Rest of World.
We do not ship goods to the following countries - Bulgaria, Iceland, Romania, Tunisia and Turkey. We reserve our right to cancel a transaction to these areas. If you would like to purchase goods from any of the countries listed above, please call us on 0749131217.
We do not issue tracking numbers for parcels shipped internationally however if you require it, please contact us at customerservice@mcelhinneys.com
8. Order Collection from Store
When ordering you can opt to collect your items instore by clicking 'Click and Collect Instore (Free)’. We aim to have all Click and Collect Orders processed and ready for collection within 3-hours during opening hours. When you receive an email confirming that your order is ready for collection that is us agreeing to the sale of goods and confirming the goods you ordered are ready for collection. Please wait until you have received your email and text confirming your order is ready for collection before coming to the store.
When collecting your items instore, remember to bring your order confirmation email. We will accept the email in printed format or on a tablet or phone. Orders are collected from the Women's Shoe Department Main Till Point instore.
9. Order Cancellation
If you have placed an order and for whatever reason you want to cancel the order, please contact at customerservice@mcelhinneys.com or call us on 0749131217. We aim to get goods dispatched to customers swiftly so it may only be possible to cancel an order before being dispatched.
10. Returns & Exchange Policy
The Returns and Exchange Policy described below only applies to online purchases made through our website or on the telephone. We are happy to offer a refund or exchange if the item is unsuitable within the cancellation period of 14 days from the day on which you received your goods. We offer the right to cancel and refund your order when sent back or returned in person in-store without undue delay and not later than 14 days from when you informed us of the decision to return. The product you return must be in new, unused, and unworn condition with all tags attached and in original packaging. It is our policy to return goods to the purchaser if we suspect that any product has been used or worn.
All dispatched orders will include order confirmation documentation which details how to return items. When returning items that included a promotional gift, this must also be returned with the returned goods or specific related products. For reasons of health and hygiene we are unable to offer an exchange or refund on the following products once the original packaging has been opened unless they are misdescribed or faulty:
- Cosmetics/fragrance
- Pierced earrings and other pierced body jewellery
- Underwear/lingerie, control lingerie & shapewear, hosiery and swimwear
- Quilts, duvets, and pillows
- Hats and hair accessories
This policy does not affect your statutory rights relating to faulty or misdescribed goods or your right to cancel orders under consumer protection. All dispatched orders will include an order confirmation form outlining your purchase details, our contact details, and our return address. Please insert the original order form or a copy of the form in the returned parcel, without this we may not be able to track your details.
Following an inspection of the returned goods and after your return has been processed you will be refunded the amount due through the original method of payment, excluding the original postage charge paid by you, if relevant. You should expect to see the refund in your account within 5-7 working days from receipt of the return confirmation Credit Memo email; however, some banks may take longer. If you do not receive your refund to your account after 10 working days, please contact customerservice@mcelhinneys.com
In-store Returns
You can return your online order instore. Please ensure that you have your original order confirmation email and order confirmation form which will be included with your order. Goods returned instore will be inspected before processing a refund to ensure the product returned is new, unused and in an unworn condition with all tags attached and in original packaging.
Exchanges
When available we are happy to exchange a product for the same product but in a different size, pending the product being returned is in a new, unused and unworn condition with all tags attached and in the original packaging. If a different product is requested, then a new order must be completed on the website by the user.

11. Settling Disputes – Online Dispute Resolution
We aim to ensure that our customers are completely satisfied with their purchase and service provided by our customer service team. However, if for any reason you are unhappy, please email us at customerservice@mcelhinneys.com and we will aim to resolve the matter immediately.
You can also submit your complaint to an online dispute resolution process operated by the European Commission by clicking here https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=EN. This will take you to the Online Dispute Resolution website which is an official website managed by the European Commission dedicated to helping consumers and traders resolve their disputes out-of-court.
12. Promotional Discounts
Coupons, discounts, postage rates and promotional discount codes offered by www.mcelhinneys.com are valid only as part of a purchase made on this website. Promotional discount codes or offers are not valid on bridal, gift cards, sale reduced items and selected special priced products. Promotional discounts codes are not redeemable in conjunction with any other promotional event. When promotional discounts have been applied to an order and if the items from that order are returned, all discounts applied at the time of purchase will be applied to the refund.
The promotional discount offered upon the completion of specific signup forms on www.mcelhinneys.com wherein customers agree to receive marketing and promotional material from McElhinneys via email and or SMS excludes selected lines, products and brands. These exclusions include but are not limited to: beauty products, selected accessories, mother of the bride/groom, Chlobo, Joseph Ribkoff and Ilse Jacobsen products. This offer also excludes all special-priced goods and sale or discounted items. This discount is valid for one use per customer only. McElhinneys reserves the right to alter the terms of this promotion at its discretion.
13. Request an Appointment
We are delighted to offer you the service of requesting an appointment for The Bridal Rooms, Communion Dresses and Men’s Suit Hire on our website. The request for an appointment is not confirmed until a member of our team emails you to confirm the requested time is available. If you fail to get a response to your request for an appointment, please email customerservice@mcelhinneys.com and a member of the team will be in touch. We reserve the right not to accept bookings requests instore. A booking fee is required to confirm appointments for our Bridal Rooms and cancellation fees may also apply if 48 hours prior notice of cancellation is not provided.
14. Intellectual Property Rights
The graphics, text, images, videos, information, and visual display contained on the website are protected by copyright laws and treaties around the world. All and any Intellectual Property Rights in the products are owned by us or our suppliers. All such rights are reserved.
15. Waste Electrical and Electronic Equipment (WEEE)
McElhinneys will take back your WEEE on a one-for-one, like-for-like basis and free of charge.
WEEE can we returned instore at our Homeware Department in McElhinneys, Ballybofey, Co. Donegal. Waste batteries are taken back in the store on a one-for-zero basis (no purchased required) as long as they are of equivalent type to that what is sold by McElhinneys. WEEE and waste batteries can also be returned to your local civic amenity site free of charge. 16. Your Opinion Matters To Us
Your opinion matters to us and helps us to continually improve. To help us better understand your shopping experience on our website we have partnered with a third-party review collection and management provider Trustpilot. Following the completion of your order on our website, we will send you an email to rate us out of 5 stars. Any review left is owned by you, and we do not have access to delete or amend. Please do not post a review that is dishonest, harmful, hateful, discriminatory, defamatory, or obscene.

The McElhinneys mobile message program (the "Program") is operated by John McElhinney Ltd (“McElhinneys”, “we”, or “us”). Your use of the Program constitutes your agreement to these terms and conditions (“Mobile Terms of Service”) and Privacy Policy (the “Agreement”). By opting in to or participating in any of our Programs, you accept and agree to these terms and conditions, including, without limitation, your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below. This Agreement is limited to the Program and is not intended to modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and Us in other contexts. We may modify or cancel the Program or any of its features without notice. Program Description:
Without limiting the scope of the Program, users that opt into the Program can expect to receive messages concerning the marketing, promotion, payment, delivery and sale of clothing, shoes, beauty, jewellery, accessories, and gift vouchers. Messages may include checkout reminders.
Cost and Frequency:
Message and data rates may apply. We do not charge for the Program, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Our Disclaimer of Warranty:

We will not be liable for any delays or failures in the receipt of any mobile messages connected with this Program.
Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of Our control. The wireless carriers supported by the Program are not liable for delayed or undelivered messages.
You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Program, any errors in such information, and/or any action you may or may not take in reliance on the information or Program.
Participant Requirements:
You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.
Age Restriction:
You may not use or engage with the Platform if you are under thirteen (13) years of age. If you use or engage with the Platform and are between the ages of thirteen (13) and eighteen (18) years of age, you must have your parent’s or legal guardian’s permission to do so. By using or engaging with the Platform, you acknowledge and agree that you are not under the age of thirteen (13) years, are between the ages of thirteen (13) and eighteen (18) and have your parent’s or legal guardian’s permission to use or engage with the Platform, or are of adult age in your jurisdiction. By using or engaging with the Platform, you also acknowledge and agree that you are permitted by your jurisdiction’s Applicable Law to use and/or engage with the Platform.
Prohibited Content:
You acknowledge and agree to not send any prohibited content over the Platform. Prohibited content includes:
- Any fraudulent, libelous, defamatory, scandalous, threatening, harassing, or stalking activity;
- Objectionable content, including profanity, obscenity, lasciviousness, violence, bigotry, hatred, and discrimination on the basis of race, sex, religion, nationality, disability, sexual orientation, or age;
- Pirated computer programs, viruses, worms, Trojan horses, or other harmful code;
- Any product, service, or promotion that is unlawful where such product, service, or promotion thereof is received;
- Any content that implicates and/or references personal health information that is protected by the Health Insurance Portability and Accountability Act (“HIPAA”) or the Health Information Technology for Economic and Clinical Health Act (“HITEC” Act); and
- Any sensitive or special category personal data including racial or ethnic origin data, political opinions data, religious or philosophical belief data, trade union membership data, genetic or biometric data (for the purpose of uniquely identifying a natural person), health data and sex life or sexual orientation data
- Any personal data of people aged under 18 without parental consent.
- Any other content that is prohibited by Applicable Law in the jurisdiction from which the message is sent.
Miscellaneous:
You warrant and represent to Us that you have all necessary rights, power, and authority to agree to these Terms and perform your obligations hereunder, and nothing contained in this Agreement or in the performance of such obligations will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable. Any new features, changes, updates or improvements of the Program shall be subject to this Agreement unless explicitly stated otherwise in writing. We reserve the right to change this Agreement from time to time. Any updates to this Agreement shall be communicated to you. You acknowledge your responsibility to review this Agreement from time to time and to be aware of any such changes. By continuing to participate in the Program after any such changes, you accept this Agreement, as modified.
